JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Madhepura P.S. Case No. 953 of 2019 registered for the offence punishable under Sections 302/34 of the Indian Penal Code. The petitioner is in custody since 13.11.2019. Mother of the deceased is the informant, who is said to have seen the deceased with other co-accused persons including the petitioner dining and consuming alcohol together in the night preceding the date of occurrence. In the next morning, she found her son dead with bleeding injury in his neck. Allegedly, the deceased was carrying worth Rs.1,50,000/-, which the miscreants had snatched. It is evident that on the basis of suspicion, the petitioner and others have been implicated.

Patna High Court CR. MISC. No.36232 of 2020(2) dt.03-02-2021 2/2 Learned counsel appearing on behalf of the petitioner has relied on orders of this Court dated 01.06.2020 passed in Cr. Misc. No. 7803 of 2020 and dated 30.06.2020 passed in Cr. Misc. No. 19925 of 2020, whereby similarly circumstanced co-accused Ranjit Kumar and Raja Paswan have been allowed regular bail.

Considering the fact that in a case of circumstantial evidence, the petitioner is in custody since 13.11.2019 and similarly circumstanced co-accused have been given privilege of regular bail, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhepura, in Madhepura P.S. Case No. 953 of 2019.
