Application has been filed for quashing the FIR dated 16-07-2011 lodged as K. Hat P.S. Case No. 303 of 2011 under Sections-419, 420, 467 of the IPC and Section-17 of the Indian Medical Council Act.

Heard learned counsel for the petitioner and the informant.

A counter affidavit has also been filed on behalf of the informant.

Counsel for the petitioner has filed supplementary affidavit wherein it has been stated that after completion of investigation, police has submitted charge sheet and the learned court below vide order dated 26-03-2012 has taken cognizance against the

Patna High Court Cr.Misc. No.39706 of 2011 dt.06-10-2017 2/2 petitioner for the offence under Sections-419, 420, 467 of the IPC and Section-17 of the Indian Medical Council Act. In such circumstances, this court finds that this petition has become infructuous.

Accordingly, this Cr. Misc. Application is dismissed as withdrawn.

The petitioner is, however, given liberty to take appropriate remedy against the order of cognizance in accordance with law, if, so advised.
