JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-05-2023 The present petition has been filed for restoration of a writ petition bearing CWJC No.736 of 2018, which has stood dismissed, vide order dated 13.09.2019, not only on account of non-compliance of the order dated 08.07.2019 but also for want of prosecution.

The learned counsel for the petitioner has submitted that the earlier counsel appearing for the petitioner in the writ petition has died, hence the present counsel has filed the present petition. It is also submitted that the rejoinder affidavit is ready

Patna High Court MJC No.1200 of 2022(3) dt.10-05-2023 2/2 and it shall be filed, within a week from today, hence a sympathetic view be taken and the aforesaid writ petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also considering the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid writ petition bearing CWJC No.736 of 2018 to its original file, subject to the registry verifying as to whether the rejoinder affidavit has been filed or not. The present petition stands allowed on the aforesaid terms.
