The grievance raised by the petitioner with regard to his non-selection on the post of a constable has been answered by the Central Selection Board. The reason indicated by them for nonselection of the petitioner is that he has equal marks vis-à-vis another recommended candidate but since that candidate was senior in age having his date of birth as 15.1.1993 whereas that of the petitioner being 25.3.1993, the petitioner has missed out the benefit of his selection.

2. It is also the stand of the Central Selection Board that similar matter has been considered and decided in the case of Sanjay

Patna High Court CWJC No.2843 of 2015 dt.17-03-2015 2 / 2 Kumar vs. State of Bihar and others, which is CWJC No. 11311 of 2013, decided on 13.1.2014.
