2. The petitioner is apprehending his arrest in connection with Begusrai Town P.S. Case No. 483 of 2024 for the offence under Sections 331(4), 305, 317(2) and 3(5) of the B.N.S.

3. As per the prosecution story, the informant has alleged that on 28.08.2024, someone has stolen his two mobile phones, one laptop, a purse carrying cash of Rs. 5,000/- and aadhar card, one nose pin, one golden chakni, one head phone and one ear bud.

4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no offence

Patna High Court CR. MISC. No.39680 of 2025(2) dt.27-06-2025 2/3 whatsoever as alleged in the F.I.R. The petitioner is not named in the F.I.R. since the F.I.R. was lodged against unknown thief. There is no recovery of any incriminating and theft article from the house of the petitioner. According to the F.I.R., in the CCTV installed nearby the house of the petitioner, the face of thief was captured in the CCTV footage but the petitioner is not the person, whose face was captured in the CCTV footage. As per para 3 of this bail petition, petitioner has no criminal antecedent.

5. Learned APP opposes the prayer for bail.

6. Keeping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate-II, Begusrai, in connection with Begusrai Town P.S. Case No. 483 of 2024 subject to the conditions as laid down under Section 438(2) of the Cr.P.C., as also with the following conditions:- (i) One of the bailors should be close relative of the petitioner.

(ii) Petitioner shall co-operate in the trial and shall
