JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 20-09-2016 Despite repeated calls, none appears on behalf of the petitioner in support of the present writ petition, though the name of the learned counsel appearing on his behalf is printed in the daily cause list.

The learned AC to SC-13 appearing on behalf of the respondent nos. 1 to 6 and the learned counsel appearing on behalf of the respondent no.7 are unanimous in their submissions that the grievances raised on behalf of the petitioner in the present writ petition have already been redressed and pending appeal has already been disposed of by order dated 17.8.2016 passed by the respondent Deputy Director of Consolidation, Sitamarhi. A copy of the aforesaid order has been brought on record by way of a supplementary counter-affidavit filed on behalf of the respondent

Patna High Court CWJC No.4704 of 2015 (3) dt.20-09-2016 2/2 no.7, which has been marked as Annexure-I.

In view of the assertions made in the aforesaid supplementary counter-affidavit, this Court is of the opinion that the present writ petition has become infructuous as the appeal filed on behalf of the petitioner has already been disposed of. Accordingly, the writ petition stands dismissed as infructuous.
