JUSTICE RAVI RANJAN ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 03-10-2016 In compliance with the directions, given by the order, dated 19.09.2016, Incharge Principal Secretary, Department of Education, Government of Bihar, is personally present in Court and has filed I.A.No. 8036 of 2016, supported by an affidavit, which indicates that action has been taken against the alleged defaulter, namely, incharge Principal of Girls High School, Hasapura, Aurangabad inasmuch as Aurangabad P.S. Case No. 154 of 2016 has been registered against Incharge Principal of Girls
Patna High Court CWJC No.3645 of 2015 (15) dt.03-10-2016 High School, Hasapura, Aurangabad, and a charge sheet has been served, as contained in Memo No. 1706 dated 28.09.2016, on the District Programme Officer, Hasapura, Aurangabad. Thus, the respondents have taken necessary action against the incharge Principal of the said school and also against the District Programme Officer aforementioned. Considering, therefore, the matter in its entirety and in the interest of justice, we are of the view that this writ petition, which has been filed, in the form of Public Interest Litigation, needs to be closed with liberty to the petitioner to approach this Court with appropriate application, in future, if so advised, and/or take recourse to appropriate provision of law. In terms of the observations, this writ application is disposed of as withdrawn.
I.A.No. 8036 of 2016 shall also stand disposed of. Further personal appearance of the Incharge Principal Secretary, Department of Education, Government of Bihar, is hereby dispensed with.
