2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.
3 . It is alleged that 7 liters of codeine phosphate of tripradin hydrochloride cough syrup was recovered from orchard in Indiranagar.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion . The alleged recovery has been made from an open place . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean

5 . Learned counsel for the State opposes the bail petition .
6. Considering the fact that recovery has been made from an open place , clean antecedent of petitioner and other circumstances of the case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge Excise Court No. 2 Supaul in connection with Misc. Excise 2111 of 2022 arising out of Excise Supaul Police Station Case No. 497 of 2022 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
