JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Petitioner being mother of the husband of the complainant is apprehending his arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 420 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand. It is alleged against the petitioner that she supported the dowry demand of car and abused the informant.
It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against the entire in-laws family. There is nothing on record to suggest that any injury has been caused to the complainant. Moreover, at earlier point of time the husband of the complainant filed Matrimonial Suit No. 147 of 2015 with a prayer for divorce,
Patna High Court Cr.Misc. No.19601 of 2016 (2) dt.03-05-2016 2/2 thereafter the present case has been lodged.
It is submitted by learned counsel for the complainant that the entire in-laws family inflicted torture to the complainant.
Considering the thrust of accusation against the husband of the complainant, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Complaint Case No. 854C of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
