JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-01-2021 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kanti P.S. Case No. 575 of 2019 for the offenses under Section 392 IPC Learned counsel for the petitioner submits that petitioner was not named in the FIR and only because of his antecedent, he has been made accused in this case. He has been remanded in this case from another case. Nothing was recovered from the possession of the petitioner to implicate the petitioner in the commission of the crime. The petitioner is in custody on remand since 27.5.2020 yet he has not been put on Test Identification Parade.

Patna High Court CR. MISC. No.36247 of 2020(2) dt.29-01-2021 2/2 Considering the aforesaid, the court is inclined to grant bail to the petitioner subject to deposit of cash of Rs. 50,000/-. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the SDJM, West, Muzaffarpur in connection with Kanti P.S. Case No. 575 of 2019 subject to deposit of cash of Rs. 50,000/-. The deposit of cash of Rs. 50,000/- shall abide by the final outcome of the present criminal case.
