JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Brahmpura P.S. Case No. 34 of 2020 registered for the offences under Sections 25(1-B) aa, 25(1-B) aaa, 25(1B), a, 26, 35 of the Arms Act and Section 30(a), 41 of the Bihar Prohibition & Excise Act.

In the instant case, huge quantity of live cartridges were recovered from the petitioner and his associates.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.35973 of 2020(3) dt.19-02-2021 2/3 petitioner has placed reliance on the order passed by a co-ordinate Bench of this Court and contends that other co-accused has been granted bail.

This Court is not impressed upon for the same in view of the fact that huge quantity of live cartridges were recovered which indicates that petitioner is involved in illegal trade of arms and ammunitions.

Having regard to the nature of allegation and the recovery made from the possession of the petitioner, this Court is not inclined to grant privilege of bail to the petitioner. The prayer for bail of the petitioner stands rejected.

However, the Court below is directed to expedite the trial and conclude the same on priority basis/on day-to-day basis positively within a period of nine months from today, failing which, the Court below shall release the petitioner on appropriate terms and conditions and submit failure report to the Registrar (Vigilance) of this Court.
