In this application for anticipatory bail the petitioner apprehends his arrest for the offence punishable under section 380 of the I.P.C.

Allegedly, the petitioner took away the trunk (big box) containing valuable papers and other articles worth Rs. 2,00,000/- from the house of brother of the Complainant. Submission is of false implication and that there is no eye witness. The petitioner used to look after the Complainant's brother who is aged about 80 years. The Complainant had greedy eye over the property and other article and the Complainant was

No.11882 of 2014 (7) dt.27-01-2015 2/2 insisting to give the house and other properties to the Complainant and his family members and for that they want to oust the petitioner from the house of his brother and on denial this false case has been instituted to which the learned A.P.P. duly assisted by the learned counsel for the Complainant opposes by submitting that the petitioner has committed theft of trunk wherein valuable papers and articles were kept.

Considering that the case is based on a complaint petition and the petitioner is residing in the house as a tenant and as such the petitioner in case of his arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of.
