JUSTICE PARTHA SARTHY ORAL ORDER 21-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The instant application for regular bail has been filed by the petitioner in connection with Nautan P.S. Case No. 130 of 2020 registered under sections 20 and 22 of the NDPS Act.

As per allegation in the FIR, 1.5 kg. ganja was recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place from the possession or from the house of the petitioner who has been falsely implicated in the case. He is in custody since 30.4.2020 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the period in custody, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Nautan P.S. Case No. 130 of 2020 on his furnishing bail bond of Rs. 10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, West Champaran, Bettiah.
