JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-03-2015 The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

Various kinds of different brands of fertilizers were recovered from the shop of the petitioner when it was found that stock register was not properly maintained. The fertilizer license of the petitioner was valid up to 31.03.2014 when the raid was laid on 13.10.2014.

It is submitted by learned counsel for the petitioner that petitioner was licensee and his application for renewal of license was pending before the authority concerned when similarly situated co-accused has been granted bail vide Cr. Misc. No. 8841 of 2015.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks and pray for regular

Patna High Court Cr.Misc. No.12796 of 2015 (2) dt.26-03-2015 2/2 bail in connection with Dhaka P.S. Case No. 175 of 2014, pending in the Court of learned Sub-Divisional Judicial Magistrate, Sikrahana at Motihari.

Accordingly the application is disposed off.
