JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 467,468,471 and 420 of the Indian Penal Code.

It is alleged that KCC loan of Rs.95000/- was taken in the name of the informant when the petitioner was identified as loanee.

It is submitted by the learned senior counsel for the petitioner that the present case has been lodged when the bank approached the informant for return of the loan amount of Rs.95000/- along with interest of Rs.4000/- and the bank has never raised dispute that the loan was not given to the informant. However, the petitioner is ready to deposit the loan amount of

No.13555 of 2015 (2) dt.07-05-2015 2/2 Rs.95000/- in three monthly installments before the learned court below which will be invested in some fixed deposit scheme in connection with the present case which will be subject to the result of the case. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for four months in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with Sanokhar (Amdanda) P.S. Case No. 114 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

On deposit of Rs.95000/-, the provisional bail of the petitioner will be confirmed by the learned court below. (Dinesh Kumar Singh, J) Anil/- U T
