Petitioners seek bail in connection with Patori (Mohanpur ) P.S. Case No. 217 of 2018 registered for the offence punishable under sections 302 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. There is no specific overt act alleged against these petitioners. There is case and counter case between the parties as is evident from Annexure-2. Petitioner no. 2, Amit Kumar, was hit by a bullet; he was treated at P.M.C.H., but the

Patna High Court CR. MISC. No.35419 of 2019(4) dt.11-09-2019 2/2 bullet could not be taken out from his chest as is evident from the Discharge Ticket enclosed as Annexure-3. Petitioners are in custody since 23.04.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner nos. 1 and 2, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, IV, Samastipur in connection with Patori (Mohanpur) P.S. Case No. 217 of 2018.
