This application, for grant of anticipatory bail, arises out of Gaunaha Police Station Case No. 41 of 2020, disclosing offences under Sections 363 and 366(A) of the Indian Penal Code.

It has been submitted by learned counsel for the petitioner that during investigation, it has come that the girl was taken away from the village and kept at some other place and she was not kidnapped, this fact find support from para 44, 45 and 46 of the case diary.

Learned APP, Sri Upendra Kumar, after going through the case diary, submits that girl in her statement under

Patna High Court CR. MISC. No.7717 of 2021(4) dt.18-01-2022 2/2 Section 164 Cr.P.C. has said that she had gone to her aunt's (Mousi) house.

Considering the aforesaid fact, the application for anticipatory bail is allowed.

Let the petitioner, named above, in the event of her arrest or surrender before the Court below within eight weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Gaunaha Police Station Case No. 41 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
