The petitioner seeks pre-arrest bail in connection with Itarhi P.S. Case No. 42 of 2016 registered under Sections 272 and 273 of the Indian Penal Code and Sections 47, 57 and 63 of the Bihar Excise Act, 2016.

Regard being had to the recovery of 718 bottles illegal wine each of 200 ml. kept in fourteen packets from the shop of the petitioner, I am not inclined to grant him pre-arrest bail. Accordingly, the application preferred under Section 438 of the Code of Criminal Procedure is rejected. In case the petitioner surrenders and seeks bail, the same shall be considered on its own merits without being prejudiced in
