JUSTICE SHAILENDRA SINGH ORAL ORDER 03-09-2025 Heard Mr. Mukesh Kumar Rana, learned counsel for the Petitioner, Ms. Megha Kumari, learned counsel for the informant and Mr. Rajendra Nath Jha, learned APP for the State.

2. The petitioner apprehends his arrest in connection with Complaint Case No. 934 of 2023 registered for the offence punishable under Section 498 A of the Indian Penal Code.

3. The main submissions advanced by the petitioner's counsel are that the petitioner is husband of the O.P. No.2 though, conciliation efforts made in between the petitioner and his wife at Patna High Court Mediation Center, Patna has failed but thereafter, at District Legal Services Authority, Araria, both

Patna High Court CR. MISC. No.39772 of 2025(4) dt.03-09-2025 2/3 the spouses settled their dispute and have decided to live apart permanently and according to the terms of the compromise/settlement, the petitioner will pay a sum of Rs. 1,75,000/- to his wife in three installments.

The aforesaid submission of petitioner's counsel regarding the compromise in between the spouses, has been accepted by the learned counsel appearing for the informant, however, the informant seeks only the relief of provisional bail to the petitioner until the entire agreed amount is made in three installments.

Considering the facts and circumstances of this case and mainly the compromise made by both the spouses to live apart permanently, this Court is inclined to grant the relief of anticipatory bail to the petitioner. Accordingly, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Complaint Case No. 934 of 2023 , subject to the conditions as laid down under Section 482(2) of the B.N.S.S.

6. The petitioner shall be bound to the terms and conditions of the aforesaid settlement made between the spouses.
