Pandey, the learned Additional P.P. and Mr. Hanslal Kumar, the learned counsel appearing on behalf of the informant. The petitioner apprehends his arrest in Bairgania P.S. Case No.129 of 2020, registered under Sections 363 and 366(A) of the Indian Penal Code.

The informant alleged that his minor daughter was enticed away by the petitioner and others but the victim was recovered and she made her statement under Section 164 Cr.P.C. in which the victim disclosed her age to be 15 years and she denied the factum of her kidnapping. She disclosed that when her parents chided her on her refusal to marry, she went to the house of her maternal uncle. Nobody kidnapped her. Taking into consideration the facts aforesaid,

Patna High Court CR. MISC. No.35828 of 2020(2) dt.23-03-2021 2/2 petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VIth-cum-Special Judge, Sitamarhi in connection with Bairgania P.S. Case No.129 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
