The petitioner apprehends his arrest in Govindpur P.S. Case No. 78 of 2015 registered for the offences punishable under Sections-302 and 201/34 of the Indian Penal Code. The informant alleged that his daughter was married with the petitioner about 20 years ago but her husband and other in-laws killed her and threw her dead body in order to conceal the evidence.
Learned counsel for the petitioner submits that the petitioner is the husband and it has come in the case diary that on account of some family dispute wife of the petitioner committed suicide after leaving the house. Even the daughter of the deceased disclosed that her mother had quarreled with her grand-mother and she committed suicide. It appears that the dead body of the
Patna High Court Cr.Misc. No.17772 of 2016 (3) dt.15-07-2016 2/2 deceased was found far away from the house and the petitioner did not inform anybody even then it has come that the petitioner was quarreling with his wife.
Considering the facts aforesaid, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the same is rejected.
If the petitioner surrenders and prays for regular then the Court below shall consider the prayer of the petitioner on its own merit without being prejudiced by this order. Kundan/- (Prabhat Kumar Jha, J) U T
