Petitioner is the husband with whom Chanchal Devi was married in the year 2010. At the time of marriage and since thereafter, demand of motorcycle continued and for that Chanchal was subjected to torture and cruelty and lastly, she was done to death. Apart from having consistency on that very score, from Paragraph-77 of the case diary dated 16.12.2013, it is evident that process under Section 82 Cr.P.C. had already been issued against the petitioner and others. That being so, in view of principle laid down by the Hon'ble Apex Court (2014) 2 SCC 171, instant petition has become non-maintainable in the eye of law and is accordingly, rejected.
