2. Petitioner seeks regular bail in connection with Gopalganj P. S. Case No. 820 of 2024 in a case registered for the offences punishable under Sections 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per the prosecution case, on 14.11.2024 at about 5:15 PM, all the F.I.R. named accused persons including this petitioner and three unknown miscreants shot the son of informant multiple times, as a result of which he died on the spot.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. During
Patna High Court CR. MISC. No.36746 of 2025(2) dt.01-08-2025 2/2 course of investigation, police inspected the footage of CCTV installed near the place of occurrence and petitioner was not seen in the said footage which itself falsifies the prosecution story. Petitioner is in custody since 25.12.2024.
5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner is named in the F.I.R. with specific accusation that he with the help of other accused persons killed the son of informant with firearms.
6. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Navya/- U T
