25-01-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

This writ application is disposed off with a direction to the learned Special Judge, SC/ST, Aurangabad to ensure compliance of his order dated 17.03.2017 in the light of the judgment of the Hon'ble Supreme Court in the case of Sakiri Vasu Vs. State of U.P. reported in (2008) 2 SCC 409 which has been followed in the case of Sudhir Bhaskarrao Tambe Vs. Hemant Yashwant Dhage reported in (2016) 6 SCC 277.

If the order of learned Special Judge, SC/ST, Aurangabad has not been complied with and the matter is

Patna High Court Cr. WJC No.2242 of 2017 (2) dt.25-01-2018 brought to the notice of the court, the Officer-in-Charge of the concerned Police Station will be liable to be proceeded against for non-compliance with the order.

The Senior Superintendent of Police, Aurangabad shall ensure that the order of the court of learned Special Judge, SC/ST, Aurangabad is complied with and proper investigation be conducted without further delay. Accordingly, this application stands disposed off.
