The present writ application has been filed for providing security to the petitioner for getting her land fenced appertaining to Tauzi No. 5660, Thana No. 39, Khata Nos. 33, Plot No. 274 and 323, situated in Mauza Rampur Adampur Garikhana, Cant Road, Khagaul, District - Patna. It is submitted by learned counsel for the petitioner that the petitioner claims the land in question by virtue of registered sale deed executed in 1981. On the part of the land in question the petitioner has constructed her house, but the neighbouring people are creating disturbance in the fenced part of the land, though in pursuance to initiation of Measurement
Patna High Court CWJC No.19244 of 2017(2) dt.11-10-2018 2/3 Case No.31 of 2015-16, the land has been measured. The petitioner transmitted an application in this regard through registered post to the district administration, i.e. Senior Superintendent of Police, Patna but till date there is no response. Hence, the present writ application.
It is submitted by AC to GP 5 that at present she does not have any instruction whether the district administration has taken any action on the representation of the petitioner or not, but she further adds to say that it will be appropriate if the petitioner submits a fresh representation before the Respondent No. 3, the District Magistrate, Patna and Respondent No. 5, the Senior Superintendent of Police, Patna ventilating her grievances, then the same will be considered within a reasonable time frame.
In the circumstances, the petitioner is permitted to submit a representation before the Respondent No. 3, the District Magistrate, Patna and Respondent No. 5, the Senior Superintendent of Police, Patna within three weeks from the date of receipt/production of a copy of this order and it is expected from Respondent No. 3, the District Magistrate, Patna and Respondent No. 5, the Senior Superintendent of Police, Patna to dispose of the representation of the petitioner within a
Patna High Court CWJC No.19244 of 2017(2) dt.11-10-2018 3/3 period of four weeks from the date of its filing. With the aforesaid observation/direction, this writ application is disposed of.
