JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 Prayer for bail of the appellant was earlier rejected by this Court vide order dated 31.8.2017 passed in Cr.Appeal(SJ) No.2510 of 2017 and allegation against the appellant is of assisting the accused person in committing rape. Submission of learned counsel for the appellant is that he is in custody for more than two years and there is no allegation of committing rape against the appellant, rather allegation is of assisting other accused in committing rape. Heard learned Special P.P.

In view of above facts and circumstances and considering the period of custody, let appellant be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the

Patna High Court CR. APP (SJ) No.2267 of 2019(2) dt.20-06-2019 2/2 satisfaction of 1st Additional Sessions Judge, Aurangabad, in connection with Mahila P.S.Case No. 07 of 2017, G.R.No. 08 of 2017, subject to the condition that one of the bailors of the appellant shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that he has to appear before the court below as and when required, otherwise his bail bonds shall be cancelled.

Accordingly, this appeal is allowed and the impugned order dated 18.4.2019 is set aside.
