The petitioner is in judicial custody in connection with Mahila (Laheriasarai) P.S. Case No. 39 of 2017 registered under Sections 498(A), 323, 504, 506 and 354/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act lodged on 13.05.2017 by the informant/complainant, Megha Kumari. As per the prosecution story, the lady alleged that at the time of marriage, her parents had given the dowry but due to non-fulfillment of 'Scorpio' vehicle, she was tortured. Accordingly, the FIR.
It is the submission of the learned counsel for the
Patna High Court CR. MISC. No.41144 of 2023(2) dt.21-07-2023 2/3 petitioner that he never demanded 'scorpio' vehicle and further he wants to move ahead in his marital journey by keeping his wife with full dignity and honour, as stated in paragraph 13 of the petition. He further undertakes that he will be visiting her house and will try his level best to bring her back to his house within a period of three weeks from today.
Taking into account the aforesaid averment made in the bail petition as also that he remained in custody since 27.02.2023 (as stated in paragraph-15 of the bail petition) and the undertaking given by him, as stated above. Let the petitioner be released on bail on furnishing bail of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Darbhanga in connection with Mahila (Laheriasrai) P.S. Case No. 39 of 2017, subject to the following conditions: (i) one of the bailor should be the family member of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial court itself;
Patna High Court CR. MISC. No.41144 of 2023(2) dt.21-07-2023 3/3 (iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of his bail bonds;
