2. The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 48 of 2025 registered for the offence under Sections 303(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner is accused of committing theft of the battery installed in the Airtel tower.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 03.04.2025.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bettiah, West Champaran/concerned Court below in connection with Jagidshpur P.S. Case No. 48 of 2025 subject to condition that:- (i).

The petitioner will mark his attendance at the Kazimohammadpur Police Station on every Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bonds of the petitioner.
