Mr.Shyameshwar Dayal ====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-01-2021 Heard learned counsel for the parties.
This application for regular bail arises out of Bounsi P.S. Case No. 71 of 2020, disclosing offence punishable under Section 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.
The police are said to have recovered 608 litres of illicit liquor from a pick-up van which was being driven by the petitioner.
Learned counsel appearing on behalf of the petitioner has submitted that the petitioner being driver of the vehicle, who was just obeying the dictates of his master, was unaware of the fact that illicit liquor was the consignment. I have carefully perused he First Information Report.
Patna High Court CR. MISC. No.35805 of 2020(2) dt.20-01-2021 2/2 There is allegation in the FIR that upon seeing the police the petitioner immediately made an attempt to flee away leaving behind the vehicle, which indicates his guilty mind. Considering the huge quantity of illicit liquor seized from the vehicle, which was being driven by the petitioner, I am not inclined to grant him privilege of regular bail for the present. This application is accordingly rejected.
The petitioner shall be at liberty to renew his prayer for bail after six months, if, in the meanwhile, there is no substantial progress at the trial.
