JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 354A,354B,380 and 504/34 of the Indian Penal Code. The prosecution case is that on 22.7.2015 at 10 P.M. the accused persons entered into the house of the informant and took away fifty thousand rupees from her box and demanded extortion of rupees two thousand per month.
It is submitted by the learned counsel for the petitioners that for the occurrence of 22.7.2015 the complaint was filed on 6.8.2015 which came to be registered as police case on 4.9.2015. On earlier point of time the petitioner side lodged a case against
Patna High Court Cr.Misc. No.18179 of 2016 (2) dt.27-04-2016 2/2 the informant being Hussainganj P.S. Case no. 325 of 2014. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the delayed filing of the complaint, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with Hussinganj P.S. Case No. 248 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
