The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, the nineteen named accused persons including the petitioner herein as also 50-60 other persons are said to have come armed with lathi, sword etc. at the door of the informant. They started to abuse and throw stone, brick etc as a result of which the grandfather of the informant was seriously injured and died on being taken to the hospital.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.48020 of 2021(2) dt.10-02-2022 2/2 that the petitioner has been falsely implicated in the case. He is one of the nineteen named accused persons. The allegations are general and omnibus in nature against about 79 persons. The petitioner is in custody since 19.3.2021 and has no criminal antecedent. Chargesheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegations in the FIR together with the petitioner having remained in custody for over 10 months, the petitioner is directed to be enlarged on bail in connection with Mohania P.S. Case no. 605 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua.
