For the Opposite Party/s : Mr. Anil Kumar Singh(APP) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 26-03-2015 The petitioners are alleged to have committed the offences punishable under Sections 341, 323, 307, 504 and 379/34 of the Indian Penal Code, for which Murar P.S. Case No.58 of 2011 was registered against them.

Apprehending arrest, the petitioners filed A.B.P. No.488 of 2014 in the court of the Sessions Judge, Buxar. The same was dismissed on 1.8.2014. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C. Heard learned counsel for the petitioners and learned A.P.P. for the State.

The serious offence alleged against the petitioners is referable to Section 307 I.P.C. The petitioners filed Annexure 3,

Patna High Court Cr.Misc. No.37475 of 2014 (2) dt.26-03-2015 2/2 which is the injury certificate issued by the Sadar Hospital, Buxar. The injury said to have been received by the informant is simple in nature, although caused by hard blunt object. This Court is of the view that investigation into the allegation in the instant case does not necessitate that the petitioners must be arrested. The application is allowed. In the event of arrest, all the petitioners, named above, are directed to be released on bail on furnishing the bail-bond of Rs.10,000/-(ten thousand) each along with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar, in connection with Murar P.S. Case No.58 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
