JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bhagwanpur Police Station Case No. 191 of 2014 registered for the offences punishable under Section 399, 402 of the Indian Penal Code and section 25(1-b) A/26/35 of the Arms Act and under section 3⁄4 of the Explosive substance Act.

Taking into consideration that co-accused Shailendra Prasad, who was apprehended in this case disclosed the name of petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Bhagwanpur Police Station Case No. 191 of 2014, pending in the court of Chief Judicial Magistrate, Siwan

Patna High Court Cr.Misc. No.11631 of 2015 (4) dt.31-07-2015 2/2 stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
