Case No.61 of 2012 along with another person, by name Rakesh Singh. The offences alleged against the petitioner and other accused are referable to Sections 419, 420, 120B, 467 and 468 I.P.C. Apprehending arrest, the petitioner filed A.B.P. No.1273 of 2012 in the court of the Sessions Judge, Motihari. The same was dismissed on 21.12.2012. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.

Record discloses that another co-accused Rakesh Singh has been granted anticipatory bail by this Court in Cr.Misc. No.17596 of 2013 on 22.11.2013. As a matter of fact, the person,

Patna High Court Cr.Misc. No.37477 of 2014 (2) dt.26-03-2015 2/2 who has been granted bail, was the main accused. The application is allowed.

In the event of arrest, the petitioner is directed to be released on bail on furnishing the bail-bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Chakia P.S. Case No.61 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
