2. Heard learned counsel for the petitioners and learned APP for the State.

3. The petitioners have preferred this application for grant of regular bail in connection with Chandi P.S. Case No. 73 of 2023 dated 07.03.2023 registered for the offences punishable under Section 147, 148, 149, 323, 336, 337, 338, 326, 307, 302 , 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

4. As per the prosecution case, while the informant

Patna High Court CR. MISC. No.40102 of 2023(3) dt.25-07-2023 2/3 was at his home, the petitioner and the co-accused person came and started assaulting and pelting stones upon him. The other co-accused persons also fired on the informant and others. During the course of this incident, one Dhannu Singh died and others sustained injury who were taken to the hospital for treatment

5. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. The other co-accused persons have already been granted bail by the Co-ordinate Bench vide order dated 26.06.2023 passed in Cr. Misc. No. 33622 of 2023 The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 07.03.2023.

6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara, in connection with

8. The application stands allowed.
