Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offence punishable under Sections 20(b)(ii)C, 22(b) of the N.D.P.S.Act, 1985.

10.07 Grams of Heroin was recovered from possession of the petitioner.

Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. He further submits that it appears

No.49017 of 2021(4) dt.05-05-2022 2/2 from the FIR as well as seizure list that 10.07 Grams of Heroine has been recovered from conscious possession of the petitioner and the petitioner is in custody since 25.06.2021. Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that the F.S.L. Report confirms that the recovered article is Heroine.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Nawanagar (Basudeva O.P.) P.S.Case No.222 of 2021 pending in the court of learned District and Sessions Judge-cum-Special Judge, N.D.P.S. Act, Buxar.

Prayer is refused.
