JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-04-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 16.12.2020, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner, learned A.P.P. for the State and Sri Randhir Kumr, learned counsel appearing on behalf of informant through video conferencing. The petitioner apprehends his arrest in connection with Khodawandpur P.S. Case no. 254 of 2019, registered under Sections 409, 419, 420, 467, 468 and 471 of the Indian Penal Code.
The accusation is that Eknath Pathak, Shambhu Prasad Singh and Shivagya Sahu, Principal, Accountant and Teacher, respectively, of MRD Inter College Meghaul,

No.35637 of 2020(2) dt.15-04-2021 2/3 Begusarai in collusion with others opened the account in the Begusarai Central Co-operative Bank, Khodawandpur Branch in the name of school with collusion of the Branch Manager and deposited salary of employees of the school in between month of July, 2018 to February, 2019 worth of Rs. 39,93,000/- and the same was disbursed illegally. When the informant being the In-charge Principal of the said school came to know then he made query to Eknath Pathak, the then Principal of the school on which he gave threatening for dire consequences. Learned counsel for the petitioner submits that petitioner is the then Manager of Begusarai Central Cooperative Bank and he has falsely been implicated in this case with ulterior motive only to give undue pressure due to dispute of management of the school. Further submission is that coaccused Eknath Pathak has already been allowed privilege of pre-arrest bail vide Criminal Miscellaneous No. 33678 of 2020 on 19.03.2021.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like
Patna High Court CR. MISC. No.35637 of 2020(2) dt.15-04-2021 3/3 amount each to the satisfaction of learned A.C.J.M. Manjhaul, Begusarai in connection with Khodawandpur P.S. Case no. 254 of 2019, subject to the condition as laid down under Section 438
