Heard learned counsel for the petitioner and learned APP for the State, Sri Chandra Bhushan Prasad. 2.

The Investigating Officer of the case, in compliance of the order dated 22-6-2026, is present in the Court.

The learned APP, at the outset, submits that a counter affidavit duly sworn by the Circle Officer, Dumariya, is going to be filed today.

The Court has perused the counter-affidavit.

Learned counsel for the petitioner, after some arguments, seeks permission to withdraw the anticipatory bail application with liberty to the petitioner to surrender and seek regular bail.

Permission is accorded.

Accordingly, the anticipatory bail application is dismissed as withdrawn.

It is made clear that if the petitioner surrenders and seeks regular bail, in that event, the learned district court shall consider the case on its own merits without being prejudiced by the fact that petitioner before this Court withdrew the anticipatory bail application.

The personal appearance of the Investigating Officer of the case is dispensed with.
