2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Belhar P.S. Case No. 74 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 109, 74, 303(2), 352, 351(2) and 3(5) of BNS.

3. The allegation against petitioner is to assault informant and others alongwith co-accused person causing head and bodily injuries having intention to cause their death, where occurrence alleged to be arising out of drainage issue.

4. It is submitted by learned counsel appearing

Patna High Court CR. MISC. No.39280 of 2026(2) dt.18-06-2026 2/3 on behalf of the petitioner that present occurrence appears free fight in nature, where both parties received injuries, therefore, it cann be said safely that petitioner was not under intention to cause death of the injured informant and other injured persons. It is submitted that for same set of occurrence petitioner's side also lodged a case, which has been registered as Belhar P.S. Case No. 73 of 2025. It is submitted that upon medical examination, injury of both injured including informant found simple in nature. Petitioner claimed clean antecedent.

5. Learned APP opposes the prayer of bail.

In view of aforesaid factual submission and by taking note of fact as prima-facie occurrence appears free fight in nature, where injury as alleged to be caused by petitioner, upon medical examination found simple in nature, accordingly petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks, is directed to be released on
