JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 406, 463, 471, 420 and 504 of the Indian Penal Code. It is alleged that the petitioner being the uncle of the informant executed a sale deed with regard to share of land of the informant on 26.05.2015 in favour of oneAbdul Matin, the said land falls in the share of the informant by virtue of partition of 1997 and there is title suit pending between the parties It is submitted by learned counsel for the petitioner that the said land fell in the share of the father of the petitioner by virtue of partition in 1954 and there is no partition in 1997 hence the petitioner executed the sale deed with regard to his share of land.

Considering the nature of accusation in the background

Patna High Court Cr.Misc. No.15075 of 2015 (2) dt.13-05-2015 2/2 of serious land dispute and title suit is pending between the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bangaon P.S. Case No.5 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
