JUSTICE SATYAVRAT VERMA ORAL ORDER 25-01-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Mufassil P. S. Case No.165 of 2020, instituted for the offences under Section 302/ 34 of the Indian Penal Code and Section 27 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 08.03.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of firing at the deceased by this petitioner and Happy Sahani hitting the chest and panjara of the deceased leading to death.

The learned A.P.P. for the State opposes the bail application and submits that there is a direct allegation of firing against this petitioner and Happy Sahani. As such, the petitioner, for the present, is in the category of main assailant. Considering the fact that the petitioner is alleged to be the main assailant, the Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner stands rejected.
