====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-01-2021 Heard learned counsel for the petitioner and learned A.P.P for the State.
The petitioner seeks bail in Dhankund P.S. Case No. 68 of 2019, registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.
As per the FIR, daughter of informant was done to death by the accused persons including this petitioner due to non-fulfillment of demand of dowry. Petitioner is husband of the deceased.
It is submitted on behalf of petitioner that there is general and omnibus allegation against him. In fact, the deceased died due to illness. Petitioner is in custody since 19.06.2020 having no criminal antecedent.
Patna High Court CR. MISC. No.35548 of 2020(3) dt.29-01-2021 2/2 However, counsel for the State vehemently opposed the bail application and submitted that petitioner is husband of the deceased and the deceased died within seven years of her marriage at her sasural in unnatural circumstances. Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
