JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-08-2019 Today, this petition has come under the heading 'To Be Mentioned' for necessary correction in the order dated 07.08.2019 passed in Cr. Misc. No.35793 of 2019.

Perused the order dated 07.08.2019 as well as the record in the present case. It appears that in the fourth paragraph of the order inadvertently "learned counsel for the petitioner submits" has been incorporated whereas no one had appeared on behalf of the petitioner on that day.

Under the facts and circumstances, the fourth paragraph of the order dated 07.08.2019 passed in Cr. Misc. No. 35793 of 2019 is modified to the extent that it should be read as "there is no recovery from the conscious possession of the petitioner and there is no compliance of Section 100 Cr.P.C."
