Permission is accorded.
Accordingly, the petition of petitioner no.2, namely, Baleshwar Ray is dismissed as withdrawn.
Heard learned counsel for the petitioners and learned APP for the State.
The petitioner nos.1 and 3 are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 448, 307, 302, 379, 504 and 506 of
Patna High Court CR. MISC. No.48038 of 2021(2) dt.24-03-2022 2/3 the Indian Penal Code.
It is a case of assault upon the informant by means of hard and blunt substance as a result of which Nand Kumar died.
It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that specific allegation of assault is against co-accused Kamal Kishore Rai and Upendra Rai and not these petitioners and only allegation against the petitioners is that they caught hold to the deceased. Petitioners have got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioners, namely, Chandan Rai @ Chandan Kumar and Shirda Ray in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Danapur, Patna in connection with Maner P.S. Case No. 607 of 2020, subject to the conditions as laid down under
Patna High Court CR. MISC. No.48038 of 2021(2) dt.24-03-2022 3/3 Section 438(2) of the Cr.P.C.
