The petitioner No. 2 apprehends his arrest in connection with a case registered for the offences punishable under Sections 323/341/436/504/506/34 of the Indian Penal Code. While granting anticipatory bail to petitioner No. 1, this Court had kept the matter pending with regard to the present petitioner to ascertain as to whether there was any evidence regarding the petitioner having burnt the house. Diary in this case was called for earlier, which has, since been received.
Learned counsel for the State after perusal of the case diary submits that there does not appear to be any cogent material which would show that the room had been burnt by the present petitioner as has been alleged against him.
Patna High Court Cr.Misc. No.19545 of 2016 (3) dt.16-09-2016 P2/2 Taking into consideration such facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Purnea in connection with dagaruwa P.S. Case No. 188/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
