The petitioner apprehends his arrest in Hasanpur P.S. Case No. 87 of 2013, registered for the offences punishable under Section 304-B, 201/34 of the Indian Penal Code and 3⁄4 of D.P. Act..

The father of the victim made allegation that his daughter was done to death due to non-fulfillment of demand of dowry and the dead body was also disposed of. Learned counsel

Patna High Court Cr.Misc. No.37490 of 2014 (2) dt.17-03-2015 2/3 for the petitioner submits that the petitioner is husband but he never demanded dowry. Deceased fell ill. She was bleeding from her nose and mouth and she was taken to a doctor but she could not survive. Even the witnesses have also state the same facts. It appears that the petitioner is the husband of the deceased and the informant made very specific allegation that his daughter was subjected to different sorts of torture and she was done to death. Deceased before her death informed the informant on telephone that she was likely to be killed.

Considering the facts aforesaid I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
