2. At the very outset learned counsel for the opposite party undertakes on instruction that the subject Matrimonial (restitution of conjugal rights) Case No. 374 of 2016 shall be withdrawn by the opposite party within a period of three weeks from today.

Having regard to the stand of the opposite party, the present petition stands disposed of with an observation that the petitioner shall be at liberty, in the event of failure on the part of the opposite party to withdraw the said Matrimonial (restitution of conjugal rights) Case No. 374 of 2016 within a period of three weeks from today, to move for revival of the present
