JUSTICE SANJAY PRIYA ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Barahiya P.S. Case No.206 of 2015 instituted for the offence under Section 302/34 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioner has submitted that there is no allegation against the petitioner. The police after investigation did not sent up the petitioner for trial. The cognizance has been taken against the petitioner also by the court below. Learned counsel for the petitioner has further submitted that petitioner is Constable in CRPF. He was on duty on 25.2.2017 in support of which he has filed certificate issued by the Commandant of CRPF enclosed as Annexure-2 series. From the written report, it appears that although the petitioner has been
Patna High Court Cr.Misc. No.52299 of 2017 (5) dt.19-12-2017 2/2 named but no specific allegation has been levelled against the petitioner. The counsel for the petitioner has submitted that other similarly situated accused person has been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 9.11.2017 passed in Cr. Misc. No.52723 of 2017. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, namely above, within six weeks from today, in connection with Barahiya P.S. Case No.206 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M.
, Lakhisarai, subject to the conditions (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason will automatically cancel bail bond of the petitioner and (3) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
