02-06-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in relation to NH Bangara P.S. Case No. 18 of 2016 registered under Sections 302/34 of the Indian Penal Code.

The allegation against the petitioners is that the petitioners assaulted the deceased because of which she fell down and injured and after certain time in course of treatment she died.

Learned counsel for the petitioners submits that the deceased was unsuitable mind, in fact, she was in

Patna High Court Cr.Misc. No.19565 of 2016 (2) dt.02-06-2016 2 / 2 depression and she had committed suicide. In support thereof supplementary affidavit has been filed, and on perusing the post mortem examination report, it clearly shows that absolutely no external injury found, but from the nasal and mouth frothing was coming out which was primarily sign of death by poison.

Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the petitioners, namely, Renu Devi, Binod Mahto and Baidhnath Mahto, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur, in connection with NH Bangara P.S. Case No. 18 of 2016, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
