The petitioners, namely, Amar Nath Singh and Bhogendra Singh, apprehend their arrest in Ladania P.S. Case No. 32 of 2014 registered under Sections 406, 420, 120-B of the Indian Penal Code.
The informant alleged that the petitioners persuaded him to be associated with Gramin Bharat Shri Ram Janki Club for getting benefit from the NABARD. The informant and others deposited Rs. 50/- per month for the membership of the aforesaid club. They deposited money for six months but no benefit was given to the members of the club and the contribution amount was also misappropriated by the petitioners. It has been submitted that the petitioners have not taken any money from the members nor the club was formed and the members of the club, after being
Patna High Court Cr.Misc. No.20121 of 2016 (3) dt.18-07-2016 2/2 recognized by the NABARD, would get benefit from the NABARD but the time has not come. There is no chit of papers to show that the petitioners have taken any money from the informant and others.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in Ladania P.S. Case No. 32/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
